The Catholic Community Jesus Child, a non-profit association registered with CNPJ 36.052.249/0001-98, established at Estrada Divino Espírito Santo, 577 Carangola, Petrópolis, RJ, Brazil – Zip Code: 25715-410, relies on the services of the social enterprise Betânia Serviços Solidários, registered with CNPJ 56.263.989/0001-80, established at Rua Santos Dumont, 143, Centro, Petrópolis, RJ, Brazil – Zip Code 25625-090, to create, manage and promote its donor program THE MAGI, hereinafter referred to as the PROGRAM.

Both institutions, as controllers of the PROGRAM, with regard to the collection, protection and use of data from each and every donor who registers and participates in the PROGRAM with their monetary donation, apply the following privacy policy, established below for the knowledge of the general public.

Introduction

For the Catholic Community of Jesus Menino and the social enterprise Betânia Serviços Solidários, the privacy and security of data provided by donors to the PROGRAM are priorities. In order to maintain transparency, we have published this Privacy Policy, which establishes how the data of each and every donor who participates in the PROGRAM is collected, protected, and used.

By becoming a donor and registering for the PROGRAM, you understand that we will collect and use your personal information in the ways described in this Policy, which fully complies with Brazilian legislation concerning Federal Law No. 13,709/18 – General Data Protection Law (“LGPD”).

Data protection laws vary by country. Regardless of the location and jurisdiction where your information is processed, the same protections described in this Policy will apply in all cases.

  1. Data collection

In order to make the Jesus Child community donor PROGRAM viable, we will collect and use the following data:

  • Personal data provided by the data subject
  • Full name (required)
  • Email address (required)
  • Date of birth
  • Gender
  • Mobile phone
  • Personal data collected automatically
  • IP address
  • Geolocation
  • Information about the accessing device (e.g. model, manufacturer, operating system)

  • How do we collect your data?

Your personal data is collected by filling out the donation form, available on the PROGRAM landing page, as well as through another ad hoc form for those who wish to participate in the PROGRAM without using the form available on the PROGRAM landing page. 

  • Purpose

We collect your data in order to send you information about the PROGRAM, as well as spiritual and reflection material, and news about the life and mission of the Comunidade Jesus Child. We also collect your data in order to send you possible surveys that aim to improve our PROGRAM and our interaction with all donors of the PROGRAM.

Therefore, the data and information provided will not be used for any purpose other than that for which they were provided.

Under no circumstances will any donor data be sold or shared with third parties other than the PROGRAM, that is, only the controllers of the RAINHAS E REIS PROGRAM, and authorized members of Betânia Serviços Solidários and the Comunidade Jesus Menino, will have access to the data collected. 

  1. Consent

We process your personal data based on your consent. Consent is the free, informed and unequivocal expression by which you authorize approved members of Betânia Serviços Solidários and Comunidade Jesus Menino to process your data.

Consent will be given when you fill out your data on the donation form on the landing page or any other form offered by the PROGRAM. No personal data is collected outside of these forms. By filling out this form, you allow the collection of information and its maintenance in the databases.

Therefore, in accordance with the General Data Protection Law in Brazil, your data will only be collected, processed and stored with prior and express consent.

You may revoke your consent at any time and at no cost.

It is important to note that revoking consent for data processing may imply the impossibility of adequate performance of the PROGRAM. Such consequences will be informed in advance.

  1. What are your rights?

 

The Jesus Child Catholic Community and the social enterprise Betânia Serviços Solidários guarantee donors of the PROGRAM their rights as data subjects as stated in article 18 of the General Data Protection Law in Brazil. This way, you can, free of charge and at any time:

  • Confirm the existence of data processing, in a simplified manner or in a clear and complete format.
  • Access your data, being able to request it in a legible copy in printed form or by electronic means, secure and suitable.
  • Correct your data, by requesting its editing, correction or updating.
  • Limit your data when unnecessary, excessive or processed in non-compliance with the legislation through anonymization, blocking or deletion.
  • Request the portability of your data, through a report of registration data.
  • Delete your data processed based on your consent, except in cases provided for by law.
  • Revoke your consent, disallowing the processing of your data.
  • Find out about the possibility of not providing your consent and about the consequences of refusal.

In order to ensure your correct identification as the holder of the personal data subject to the request, we may request documents or other evidence that can prove your identity. In this case, you will be informed in advance. 

  1. How and for how long will your data be stored?

Your personal data collected will be used and stored for as long as necessary for the development of the PROGRAM, so that its purposes are achieved, considering the rights of data subjects and controllers.

If you are a recurring donor, in general, your data will be kept as long as you are a recurring donor, a Magus of the PROGRAM. When you stop being a recurring donor, your data will remain stored and protected for a total period of 5 years after your last donation.

If you are a one-time donor, your data will remain stored and protected for a total period of 5 years after your last donation.

Once the personal data storage period has ended, it will be deleted from our databases or anonymized, except for the cases legally provided for in article 16 of the general data protection law in Brazil, namely:

I – Compliance with a legal or regulatory obligation by the controller;

II – Study by a research body, ensuring, whenever possible, the anonymization of personal data;

III – Transfer to a third party, provided that the data processing requirements set forth in this Law are respected; or

IV – Exclusive use by the controller, with access by third parties prohibited, and provided that the data is anonymized.

That is, personal information about you that is essential for complying with legal, judicial and administrative determinations and/or for exercising the right of defense in judicial and administrative proceedings will be maintained, despite the exclusion of other data.

  1. What do we do to keep your data safe?

To keep your personal information secure, we use electronic and management tools designed to protect your privacy.

We apply these tools taking into account the nature of the personal data collected, the context and purpose of the processing, and the risks that any violations would generate for the rights and freedoms of the data subject of the data collected and processed.

Among the measures we adopt, we highlight the following:

  • Only authorized persons have access to your personal data
  • Access to your personal data is only granted after a confidentiality commitment
  • Your personal data is stored in a safe and suitable environment.

It is important to note that no website is entirely safe and risk-free. Despite all our security protocols, problems may occur due exclusively to third parties, such as cyber attacks by hackers, or as a result of the negligence or carelessness of the user/donor.

And although we adopt high security standards in order to avoid incidents, there is no virtual page that is completely risk-free. In this sense, we are not responsible for:

I – Any consequences resulting from the negligence, imprudence or lack of skill of users in relation to their personal data. We guarantee and are only responsible for the security of the data processing and compliance with the purposes described in this instrument.

We emphasize that the responsibility for the confidentiality of access data lies with the user.

II – Malicious actions by third parties, such as hacker attacks, unless proven to be negligent or deliberate conduct on the part of the Catholic Community Jesus Child or the social enterprise Betânia Serviços Solidários

We would like to point out that in the event of security incidents that may generate significant risk or damage to any of our users/donors, we will notify those affected and the National Data Protection Authority about the incident and will take the necessary measures.

III – Inaccuracy of the information entered by the user/donor in the records required for the use of the PROGRAM services; any consequences arising from false information or information entered in bad faith are the sole responsibility of the user/donor.
